(to the tune of) What's going on?

As others have said, as all of us knew already...we had a sort of victory the other day, a moment in time. But, don't push me! I like to sort of roll around in them like a mud bath. Lovely silky moment and then, well, enough is enough.

Here is a brief and very bad synopsis of the moment. Victor Gonzalas is up to bad tricks at the mullecito. Go there and see what I mean. Want the flamingo to stay? Do something. At the very least GO there if you are on island. Get mad. Get active.

The victory has its black side, of course. Write, call, go make an appointment with the mayor if you can and ask what exactly the victory meant, in regard to the Zoni project (new road bulldozed out there behind the dunes...real nice), the Terruno project, Victor Gonzalas, the mayor's true position on development. I'm not insinuating anyting, but I am saying...all is not la la loverly.

And it's 1, 2, 3, what are we fighting for?

Here's what...and you know I can easily post a few hundred more.


But I'm not going to. Instead I'm going to post something way cool that Al brought by the cart for me to look at (ok, I waylaid him off the bridge and he came over, carrying a box that was pretty battered). Inside his flat rate box was an awesome fossil that he & Mary found while they were back in Texas. We set it up so I could get a shot of it. I think it would look very cool on the cart and Al agreed...and then he took it home. Boy, some people are SO selfish!!!

It's hard (for me) to get the nuances of ripples,
plus there are oyster shells and much more in there...very wonder full

The sea almonds are going...well, nuts!

as are the papayas - finally they are growing too fast for the critters to eat them in the bloom

Sometimes my yard is just heartbreakingly beautiful...okay, a lot of times

This is for anyone who can identify this tree and blossom...and for my brother, to let him know that that flower wasn't red...it was DEAD! Oopsy, I hate it when that happens!

So, onward we go, in the joy and the beauty and the fight to keep them from clear and present danger. But in the MEANTIME...Susie's opens tomorrow night for a new season. The air is cool and the sky is blue and the breeze is up enough that I got fairly soaked on one side coming home this afternoon in the dinghy. But it was warm and beautiful and that is why god made showers.

Follow up from yesterday's post

This is further explanation of what this very frightening piece of legislation (which incorporates part of the word legal and I personally cannot see how any of this can be legal in a democratic society) would actually mean in practice. Análisis de Lic. Pedro Saade Re: P de la C 1649 y P de la S 880

Observaciones Finales de Licenciado.....
1. El proyecto representa la amenaza más seria a la protección de la salud y el medio ambiente desde el origen de la legislación ambiental de los 1970's.

2. Se intensificará deterioro en usos de terreno y protección ambiental, particularmente en ausencia de un Plan de Uso de Terreno.

3. No es una ley dirigida a enmendar razonablemente trámites de permisos sino que busca excluir participación en procesos de otorgamiento de permisos de usos de terrenos. Es profundamente anti-democrática.

4. Excluye a los Tribunales de Justicia, efectivamente.

5. Implica despidos de empleados públicos.

6. Pretende reinterpretar la cláusula de protección constitucional del Art. VI, sec. 19 y otras protecciones a la ciudadanía.

7. La ley crea una estructura compleja, de varios componentes que puede resultar inoperante.

Aquí les envío los asuntos más nocivos del proyecto de ley sobre los permisos. Los verán en color rojo y subrrayado.

A mi juicio debe destacarse lo siguiente:

1. El "Profesional Certificado". Este es una especie de mercenario que va a repartir permisos a tutiplén, al mejor pos$$$tor.

2. La Oficina de Gerencia de Permisos va a preparar los documentos ambientales y también los va a evaluar y aprobar. Es decir, se convierte en juez y parte.

3. La fianza que se exige para revisar un permiso que haya sido otorgado como final, es un atropello a los derechos de los ciudadanos, discriminatoria e inconstitucional.

4. Las agencias como el DRNA, JCA, DA, entre otras, se conviertan en agencias fiscalizadoras, pero al final del proceso, una vez el permiso ha sido otorgado.

5. La creación de la Junta Apelativa, desplaza a los tribunales y los margina a recursos de certiorari.

En resumen, esto es una barbaridad mayúscula y la culminación del proceso de entrega al sector privado del patrimonio del País. Pero además, es una invitación a la anarquía en los usos del territorio y una convocatoria a la confrontación con las comunidades y el País en general.

FINAL OBSERVATIONS from the Licenciado:

1. The project represents the most serious threat to the protection of human health and the environment from the origin of the environmental legislation of the 1970's.

2. Intensified deterioration of land uses and environmental protection, particularly in the absence of a Land Use Plan.

3. It is not a law to amend reasonably permits but seek to exclude involvement in permitting use of land. It is profoundly anti-democratic.

4. Actually excludes the courts,

5. It involves the dismissal of public employees.

6. Seeks to reinterpret the constitutional protection clause of article VI, sec. 19 and other protections to citizens.

7. The law creates a complex structure of several components that may be ineffective.

ANALYSIS by TATO Jose E. Rivera Santana: Here are the most damaging aspects of the permit proposed law. They will be in red and underlined.

To the best of my knowledge the following should be emphasized:

1. The "Certified Professional". This is some kind of mercenary that will give permits left and right, to the highe$$$t bidder.

2. The Office of Permit Management will prepare the environmental documents and will also evaluate and approve them. That is, it turns into judge and concerned party.

3. The payment required for the revision of an approved final permit is a violation citizen´s rights, it is discriminatory and unconstitutional.

4. The agencies like DNER, EQB, DA, among others, will turn into supervisory agencies but only at the end of the process, when the permit has already been given.

5. The creation of the Appeals Board pushes out and marginalizes the courts to become a certiorari recourse.....

To summarize, this is a major atrocity and the culmination of the process of giving our heritage to the private sector. Furthermore, it is an invitation to anarchy regarding the use of resources and a call for confrontation with communities and the country in general.

Melvin Pereira del Muinicipio de Culebra nos dejará saber hoy:
1. El Alcalde de Culebra Abraham Peña Nieves, asistirá a las vistas el 20 de mayo (miércoles) a las 10:00am en el salón de la rotonda. Presentará una oposición total al proyecto por ser inconstitucional el que un panel ejecutivo que no sepa sobre el estilo de vida de la comunidad de Culebra, intente controlar los permisos que ACDEC otorga para controlar el desarrollo de la isla y 2. La Federación de Alcaldes (PNP) estará en las vistas para expresarse sobre el impacto que este proyecto tendrá en sus municipios.

Melvin Pereira from the Municipio of Culebra let us know today:

1) the Mayor of Culebra Abraham Peña Nieves, will be attending the hearings on the 20 of may (Wednesday) at 10:00a.m. at the rotonda salon, he'll be presenting a total opposition to the project, because its unconstitutional that an executive panel that doesn't know the way of living of the Culebra community ,try to control the permits that acdec allows to the controlled development on the island, and,
2) the federation of mayors (pnp) will be there on the hearing expressing on the project the impact that will have on the municipalities.

Ready for some action?

Una amenaza a la valiosa particípación pública en el proceso de planificación.

Se está discutiendo la Resolución P. de la C. 1649 que propone cambios drásticos en el proceso de permisología de Puerto Rico. Estos procedimientos se están llevando a cabo de una forma muy poco transparente, pues han empezado vistas públicas sin anunciarse y en un domingo, solo unos pocos días despúes que la resolución fuera sometida.

Se nos ha informado que los cambios obligarán a la gente a pagar dinero si quieren intervenir en la evaluación de proyectos de desarrollo, lo que sería insconstitucional. También se nos ha informado que los cambios crearán una sola oficina reesponsable de los permisos, evaluación y aprobación de los proyectos de desarrollo. Lo preocupante aquí es que mientras el Gobernador Fortuño se postuló y fue elegido a base de una plataforma anti corrupción, este cambio podría eliminar la supervisión necesaria para cumplir con este compromiso.

En relación a Culebra, la resolución propone cambios a la Ley 66 de 1975 (según enmendada) en relación a ACDEC. Nos han informado que los cambios propuestos le quitarán a la Junta el poder de vetar y su responsabilidad de hacer cumplir la ley, permitiéndole al Gobernador nombrar intereses privados a la Junta y elimina las limitaciones en cuanto a la altitud de los edificios en la isla...entre muchas otras cosas que no hemos tenido el tiempo de evaluar y considerar apropiadamente.

Comentario: El público se merece tiempo para disfrutar de su derecho a un proceso público legítimo para evaluar y someter comentarios para Resolución P. de la C. 1649.

Resolutions introduced in House and Senate: A Threat to Meaningful Public Participation in Planning Process.

Resolution P. de la C 1649 proposing drastic changes to the permitting process of Puerto Rico is being heard today. This is proceeding in such a non-transparent fashion as to begin unannounced public hearings on a Sunday, only a few days after the resolution was introduced.

We are told the changes will force people to put up money if they wish to intervene in evaluation of development projects which would be unconstitutional. We are also told the changes will create a single permitting management office that will be responsible for both evaluation, and approval of development projects. The concern here is that while Governor Fortuño ran and was elected on an anti-corruption platform, this change could eliminate all of the oversight needed to insure this commitment.

Regarding Culebra, the resolution proposes changes to Law 66, 1975 (as amended) involving ACDEC. We have been told that the proposed changes will eliminate veto and enforcement powers from the board of ACDEC, allow the Governor to appoint private interests to the Board and remove existing constraints as to the heights of buildings for the island...among many other things we have not had the time to properly review and consider.
